Mortgage of Premises upon the Beach at Lowestoft for securing £60 and Interest

Mrs Elizabeth Cook & ors to Mr James Roope

Dated 21st July 1863

This indenture made the twenty first day of July one thousand eight hundred and sixty three between Elizabeth Cook the widow of John Cook late of Lowestoft in Suffolk Fisherman deceased Frederick Sterry (Fisherman) and Sarah Ann his wife James Cooper (Fisherman) and Elizabeth his wife Henry Hall (Fisherman) and Sarah his wife William Cook and Henry Cook (Fisherman) all of Lowestoft in the County of Suffolk of the one part and James Roope of Lowestoft aforesaid Master Mariner of the other part Whereas the said John Cook by his Will bearing date on or about the seventh day of August One thousand eight hundred and forty gave and devised the hereditaments and premises hereinafter described and intended to be hereby conveyed with their appurtenances unto and to the use of the said Elizabeth Cook his wife and her assigns for life and after her decease the Testator gave and devised the same hereditaments and premises unto such of his five children John, Elizabeth, Sarah, William and Henry as should be living at the time of his decease to be equally divided between them if more than one share and share alike as tenants in common and not as joint tenants and the heirs and assigns of the same children for ever. And whereas the said John Cook departed this life on the fourth day of December One thousand and eight hundred and fifty(?) five without having altered the said Will and the same was duly proved by the said Elizabeth Cook the sole Executrix therein(?) named on the twelfth of February following in the Episcopal Consistorive(?) Court of Norwich(?) And whereas John Cook one of the said five children of the said John Cook the Testator was drowned at sea intestate(?) on the seventh day of September one thousand eight hundred and fifty eight leaving the said Sarah Ann the wife of the said Frederick Sterry his only child him surviving And whereas the said Elizabeth Cook, Frederick Sterry and Sarah Ann his wife, James Cooper and Elizabeth his wife Henry Hall and Sarah his wife, William Cook and Henry Cook (hereinafter described as parties hereto of the first part) have applied to the said James Roope to lend them the sum of sixty pounds which he hath consented to do upon having the repayment thereof with interest secured in manner hereinafter appearing. Now this indenture witnesseth that in consideration of sixty pounds sterling by the said James Roope now lent and paid to the said parties hereto of the first part The receipt whereof they do hereby __(?) duely acknowledge and from the same do hereby respectively acquit and release the said James Roope his executors administrators and assigns. They the said parties hereto of the first part do and each of them doth hereby grant and convey unto the said James Roope and his heirs all that piece of land in Lowestoft aforesaid formerly parcel of the waste of the manor of Lowestoft called the Beach containing in length from East to West thirty feet or thereabouts and in breadth from North to South thirty five feet or thereabouts as the same is bounded by the Road or Queens Highway leading from the Rant Score over the said Beach to the sea shore towards the South by lands and tenements of Jeremiah Ling late parcel of the said waste towards the West by other parts of the said waste towards the North and by lands and tenements of William Hall late parcel of the said waste towards the east together with all those three tenements or dwelling houses and other edifices built by the said John Cook the Testator upon the same piece of land as all the said premises are now in the several occupations of the said Elizabeth Cook and of Stephen Tripp(?) and Frederick Sterry (which said piece of land by a certain grant of instrument in writing dated the thirtieth day of September one thousand eight hundred and thirty three under the hands of the Lord of the Manor and of sundry persons being Copyhold Tenants thereof and owners and occupiers of lands and tenements in Lowesotft aforesaid was granted unto and to the use of the said John Cook the Testator and Edmund Norton and the heirs of the said John Cook Testator but nevertheless as to the Estate of the said Edmund Norton therein In trust for the said John Cook and his heirs in free and common locage(?) subjects loan annual rent of one shilling payable to the Lord of the said Manor and to the payment of the like sum in the n___(?) of a relief on every death or alienation. And all the rights n____s(?) and appurtenances whatsoever to the same premises belonging or appertaining And all reversions and remainders thereof And all the estate right title and interest of the said parties hereto of the first part and only the said hereditaments and premises with their appurtenances To have and to hold(?) the said land tenements or dwellinghouses hereditaments and all other the premises hereby conveyed or ___ended(?) with the appurtenances unto and To the use of the said James Roope his heirs and assigns forever. But subject nevertheless to the proviso for redemption hereinafter contained. Provided always that if the said parties hereto of the first part their heirs executors administrators and assigns shall on the twenty first day of(?) January next pay or cause to be paid unto the said James Roope his executors administrators or assigns the sum of sixty pounds sterling with interest for the same at ten pounds per cent per annum without deduction ___(?) the said James Roope his heirs and assigns at the request costs and charges of the said parties hereto of the first part their heirs executors and administrators or assigns reconvey and assure the said hereditaments and premises with the appurtenances unto and to the use of the said parties hereto of the first part and their heirs or as they shall direct. And it is hereby declared and agreed by and between the said parties hereto that in case default shall be made by the said parties hereto of the first part their heirs executors or administrators in payment of the said sum of sixty pounds and interest as aforesaid it shall be lawful for the same James Roope his executors administrators or assigns at any time or times thereafter to enter into the possession or receipt of the rents and profits of the said hereditaments and premises hereby conveyed and assured or so intended and at his or their discretion absolutely to sell and dispose of the same or any part or parts thereof either by private or public sale and either altogether or in lots and with or without the consent of the said parties hereto of the first part their heirs executors or administrators unto any person or persons whomsoever for such sum or sums of money as can reasonably be obtained for the same and for that purpose enter into and make and execute all contracts with and to convey and assure the said hereditaments and premises or any part or parts thereof when sold unto the purchases or purchasers thereof or as he or they shall direct with full power for the said James Roope his heirs or assigns to buy in the said hereditaments and premises or any part or parts thereof respectively at any auction and afterwards to sell the same in manner aforesaid without being answerable for any diminution in the price on the resale thereof. And it is hereby further agreed and declared that all contracts which shall be entered into and all conveyances and assurances which shall be executed by the said James Roope his heirs and assigns concerning the premises shall be valid and effective to all intents and purposes not withstanding the said parties hereto of the first part their heirs executors administrators or assigns shall not join therein or assent thereto. And that it shall not be incumbent on the respective purchasers of the said hereditaments and premises or any part or parts thereof to ascertain or enquire whether previously to such sale such default in payment as aforesaid shall actually have taken place or been given. And that the receipt in writing of the said James Roope his heirs and assigns for all or any part of the purchase money shall be a good discharge to the purchaser or purchasers of the said hereditaments and premises or any part or parts thereof as well ___(?) from the application of such money. And that the said James Roope his heirs or assigns shall __(?) of the money to be produced(?) by the sale of the said hereditaments and premises and of the rents and profits thereof unto(?) such sale in the first place de__(?) the expenses of making out the title and completing such sale(?) and all other expenses consequent thereon and incident to this present security or the execution of the powers or trusts thereof. And in the next place out of all the monies aforesaid to pay himself and themselves the said sum of sixty pounds and all arrears of interest at the rate aforesaid and then do and shall pay the residual if any of the monies aforesaid unto the said parties hereto of the first part their executors administrators and assigns. And each of them the said parties hereto of the first part doth hereby for himself and herself and his and her heirs executors and administrators covenant with the same James Roope his executors administrators and assigns. That in case the said principal sum of sixty pounds and interest or any part thereof shall remain unpaid upon the said twenty day of January next then the said parties hereto of the first part their heirs executors or administrators or some ___(?) of them will so long as the said sum of sixty pounds or any part thereof shall remain due pay unto the said James Roope his executors administrators or assigns interest for the same at the rate of ten pound per percent per annum by equal half yearly payments. And that after such default of payment the said sum of sixty pounds and interest as aforesaid it shall be lawful for the said James Roope his heirs or assigns ___(?) and ___(?) to enter into hold and ___(?) and receive and take the rents and profits of the said hereditaments and premises without interruption(?) from the __(?) said parties hereto of the first part their heirs or assigns or any other person or persons whomsover. And also that they the said parties hereto of the first part and their heirs and all other persons claiming any stake(?) or interest out of the said hereditaments and premises will at the costs of the said ___(?) estate make and execute all such further assurances as the said James Roope his heirs or assigns shall reasonably require. And further that they the said parties hereto of the first part will forthwith ___(?) and __ing(?) contin__(?) of this security (?) keep insured in the(?) joint names of themselves and the said James Roope from loss or damage by fire in some ___(?) Office of Insurance all the buildings comprised in this security to the amount of sixty pounds at the least and in default of making and continuing such insurance shall permit the said James Roope to insure the same in which cas the premium and duty for so doing shall be added to the aforesaid principal sum of sixty pounds bear the like interest and shall be a further charge and lien upon the said premises. In witness whereof the said parties hereto have hereunder set their hands and seals the day and year first above.

This indenture made the twenty seventh day of January one thousand eight hundred and sixty five between the within named James Roope of the one part and the within named Elizabeth Cook, Sarah Ann Sterry James Cooper and Elizabeth his wife Henry Hall and Sarah his wife William Cook and Henry Cook (hereinafter described as parties hereto of the second part) of the other part Whereas since the executor of the within written indenture the within named Frederick Sterry has been drowned at sea And whereas the within mentioned principal sum of sixty pounds is still due and owing to the said James Roope but all interest upon or in respect of the same hath been duly paid up to the day of the date of these presents and the said parties hereto of the second part are desirous of paying off the said sum of sixty pounds and of having such reconveyance of the mortgaged premises within described as is hereinafter mentioned Now(?) this indenture ___(?) that in consideration of the sum of sixty pounds to the said James Roope paid by the said parties hereto of the second part at or immediately before the execution of these presents in full for all principal monies duly(?) owing upon them within written security the receipt whereof he it(?) James Roope doth hereby acknowledge and from the same doth release(?) and forever discharge the said parties hereto of the second part(?) respectively(?) and their respective heirs executors administrators and assigns. He the said James Roope doth hereby grant and convey And also remise release and for ever quit claim unto the said parties hereto of the second part their heirs and assigns. All and singular the piece of land tenements or dwellinghouses(?) hereditaments and other the premises in the within written indenture comprised or expressed to be thereby granted or which now by any means are vested in the same James Roope under or by virtue of the same indenture with their rights easements and appurtenances And all the estate(?) of him the said James Roope his heirs and assigns of in or to the said hereditaments and premises and every part thereof. To have and to hold the said piece of land messuages or tenements hereditaments and all and singular other the premises(?) hereby granted released or otherwise _voured(?) with their respective rights ___ents(?) and appurtenances unto the said parties hereto of the second part their heirs and assigns to then use upon the trusts and for the end intents and purposes as are expressed and declared of and concerning the same hereditaments and premises in the within recited __(?) of John Coote late of Lowestoft aforesaid fisherman deceased freed and absolutely discharged of and from all principal monies __(?) interest intended to be secured by the within written indenture __(?) of and from all actions __(?) accounts reckonings claims and demands whatsoever either at law or in equity for upon accounts or in respect of the said principal monies and interest or for upon account or in respect of the said were(?) written Indenture or of any act deed matter or thing in anywise relating to the premises and the said James Roope doth hereby for himself his heirs executors and administrators covenant with the said parties hereto of the second part respectively and their respective heirs executors and administrators or assigns That he the James Roope hath not at any time heretofore made or done or executed(?) or knowingly or willingly permitted or suffered or been part or privy(?) to any act deed or thing whereby or by reason or means whereof he in anywise prevented or hindered from granting or releasing the said hereditaments and premises intended to be hereby granted and __(?) or any part thereof unto the said parties hereto of the second part in manner aforesaid or whereby or by reason or means whereof the same hereditaments and premises or any part thereof are or is can sha__(?) or may be impeached charged affected or incumbered in Title Estate or other however. The fifteenth day of July One thousand eight hundred and ninety seven

Quit Rent 1d, Fine 2d John Love Sterry, William Henry Sterry, Samuel Ward Sterry and Mary Ann Madin admitted after the oath and under the Will of Emma Mary Sterry

Whereas at a General Court Baron holden for this Manor on the Second day of March One thousand eight hundred and seventy seven Louisa Ward Sterry and Emma Mary Sterry both of Lowesoft in the County of Suffolk Spinsters were admitted Tenants after the death of Annie Ward and under the Will of Mary Ward deceased to the Copyhold hereditaments hereinafter mentioned To hold to them the said Louisa Ward Sterry and Emma Mary Sterry their heirs and assigns as ever as tenants in common and not as joint tenants Now be it remembered that on the fifteenth day of July in the sixty first year of the Reign of our Sovereign Lady Queen Victoria by the Grace of God of the United Kingdom of Great Britain and Ireland Defender of the Faith and in the year of our Lord One thousand eight hundred and ninety seven pursuant to the Statute in this case made and provided John Love Sterry of Lower Barton Street Gloucester Grocer William Henry Sterry of Cowper Street Northampton Watchmaker Samuel Ward Sterry of the Parade Northumberland Park Belvedere, Kent, Grocer and Mary Ann Madin the Wife of then Reverend Edmund Madin of Lowestoft aforesaid Wesleyan Minister (by Herbert Edwin Toll on this part their Attorney) come before Thomas Simpson Allerton Gentleman Deputy Steward of this Manor and of the Courts thereof at the Office of Messieurs Reeve and Mayhew in Lowestoft aforesaid and inform the said Deputy Steward that the said Louisa Ward Sterry died on the Twenty second day of March One thousand eight hundred and ninety and produce an Extract from the last Will and Testament of the said Louisa Ward Sterry dated the fifth day of November One thousand eight hundred and seventy four the tenor whereof as to the disposition of her Copyhold lands and tenements holden of this Manor follows in these words that is to say "I give and bequeath unto my Sister Emma Mary Sterry All that I now possess or that I may possess at the time of my decease To hold absolutely unto and to the use of my said Sister Emma Mary Sterry her heirs executors administrators and assigns she paying thereout all my just debts funeral and testamentary expenses" as by the same Will proved in the District Registry at Ipswich of the Probate Division of Her Majesty's High Court of Justice on the Twenty third day of April One thousand eight hundred and ninety reference being thereunto had may more fully appear and they ( by their said Attorney) also inform the said Deputy Steward that the said Emma Mary Sterry died on the Twenty sixth day of April One thousand eight hundred and ninety seven without ever having been admitted to the Copyhold hereditaments so devised to her by the Will of the said Louisa Ward Sterry and they produce an extract from the last Will and Testament of the said Emma Mary Sterry dated the fourteenth day of August One thousand eight hundred and eighty eight the tenor whereof as to the disposition of her Copyhold lands and tenements holden of this Manor follows in these words that is to say "I give and bequeath unto my brothers John Love Sterry, William Henry Sterry, Samuel Ward Sterry and unto my Sister Mary Ann Madin the Wife of the Reverend Edmund Madin Wesleyan Minister the whole of my real property situate at Aland Place, Spurgeon's Score Lowestoft and all monies to which I may be entitled and all monies which may be due to me at the time of my decease to be divided among them my said Brothers and Sisters in equal proportions share and share alike." As by the same Will proved in the District Registry at Northampton of the Probate Division of Her Majesty's High Court of Justice reference being thereunto had may more fully appear. And thereupon the said John Love Sterry, William Henry Sterry, Samuel Ward Sterry and Mary Ann Madin (by their said Attorney) request the favor of the said Deputy Steward to admit them as Tenants to the Copyhold lands and tenements so devised to them as aforesaid that is to say To All that piece of land situate lying and being at Lowestoft aforesaid containing by admeasurement sixty six feet in front next Spurgeon's Score seventy feet in breadth at the southern extremity thereof and ninety six feet the whole length of the same North and South Together with the Four Tenements or Dwellinghouses erected and built thereon and known as Aland Place as the same abuts upon the said Score on the part of the North upon land and premises late of Benjamin Morris Edmonds Charles Punchard and others on the part of the West upon lands of William Henry Thirtle on the part of the South and hereditaments late of Thomas Francis Sayer on the part of the East with the right at all times hereafter of having and taking water from the well and pump standing and being on the said land and premises paying from time to time a proportionate part of the expense of the repairs thereof And the said Deputy Steward by virtue of the Statute in this case made and provided doth admit the said John Love Sterry William Henry Sterry Samuel Ward Sterry and Mary Ann Madin (by their said Attorney) Tenants thereto accordingly and doth deliver to them seizin of all the said premises by the Rod To hold to them the said John Love Sterry William Henry Sterry Samuel Ward Sterry and Mary Ann Madin and to their heirs and assigns for ever as tenants in common and not as joint tenants of the Lord at the Will of the Lord according to the custom of this Manor and form and effect of the said Will By the rents and services therefore anciently due and of right accustomed saving nevertheless every one's right thereto &c And paying the Lord of the Manor fines &c They by their said Attorney are admitted Tenants thereto but their fealty to be done therefore is on the Lords favor respited &c.

Conditional Surrender of Copyhold Land by Robert Barneby to W. James Sterry

To this Court comes Robert Barneby of Lowestoft in the County of Suffolk Carpenter a Copyhold Tenant of this Manor in his proper person and in full Court before the whole Homage Doth Surrender out of his hands into the hands of the Lord of this Manor by the proper hands of the said Steward by the rod according to the custom thereof All and singular the Messuages Lands tenements and hereditaments whatsover of him the said Robert Barneby holden of this Manor by Copy of Court roll with the appurtenances And the reversion and reversions remainder and remainders thereof. And also all the Estate right title use interest trust equity property claim and demand whatsover of him the said Robert Barneby of in and to the said premises and every part and parcel thereof. To the use and behoof of James Sterry of Lowestoft aforesaid mariner and of his heirs and assigns for ever. Upon condition nevertheless that if the said Robert Barneby his heirs executors administrators or assigns do and shall will and truly pay or cause to be paid unto the said James Sterry his executors administrators or assigns the full and just sum of one hundred pounds of good and lawful money of Great Britain together with lawful interest therefore on or upon the first day of July which will be in the year of our Lord one thousand and eight hundred without any deduction or abatement whatsoever Then this Surrender to be void and of no effect or else to be and remain in full force and virtue.

Sarah Sterry Widow and Relict and also sole Executrix of and named in the last Will & Testament of the said James Sterry by a writing under her hand Dated 13th October 1826 Did authorize and empower the Steward of the Courts of this Manor or his Deputy to enter in the Court Books or on the Rolls of this Manor satisfaction upon this Surrender and upon all other Surrenders theretofore passed by the said Robert Barneby to the use of the said James Sterry And for so doing such Writing should be a sufficent authority As witness my hand

A General Court Baron held for the said Manor on ffriday the twenty ffourth Day of July In the Twelfth Year of the Reign of our Sovereign Lord George the third by the grace of God of Great Britain ffrance ande Ireland king Defender of the ffaith &c And in the Year of our Lord One Thousand seven hundred and seventy two before Robert Reeve Gentleman steward of the said Manor.

Whereas at a General Court Baron held for the said Manor on the Eleventh Day of November which was in the Year of our Lord One Thousand seven hundred and fforty One Richard Robertson late Copyhold Tenant thereof surrendered by the Rod out of his hands into the hands of the Lord of the said Manor by the hands of the then Steward All and singular his Messuages Lands Tenements and Hereditaments holden of this Manor by Copy of Court Roll with their Appurtenances To the uses declared or to be declared in the last Will and Testament And Whereas at a General Court Baron held for the said Manor on the seventh Day of ffebruary last past it was presented by the then Homage that before that Court and since the then last the said Richard Robertson died solely seized of and in certain Copyhold Lands and Tenements held of the said Manor and because nobody came to be admitted to the same the first proclamation was made for want of a Tenant that if any one would come into Court and make any just Right or Title to the Copyhold Lands and Tenements whereof he so died seized they should be heard and received but none then came. And at the last General Court Baron held for the said Manor on the Twenty second day of June last past the second proclamation was made for want of a Tenant to the said Copyhold Lands and Tenements that if any one would come into Court and Claim any Right or Title to the same they should be ...

... heard and received but none then came. Now to this Court comes into Court Sarah the Wife of James Sterry of Lowestoft in the County of Suffolk Mariner in her own proper person and produces the probate of the last Will and Testament of the said Richard Robertson bearing date the seventh Day of December last past the Tenor whereof as to the Copyhold Lands and Tenements of which the said Richard Robertson died seized held of this Manor follows in these words In the Name of God Amen I Richard Robertson Jr(?) I Give and Devise unto my Cousin Sarah Sterry the Wife of James Sterry of Lowestoft aforesaid Mariner and to her Heirs and Assigns for ever All that my Messuage or Tenement with the Ground Hereditaments and Appurtenances thereto belonging or in any wise appertaining situate lying and being in Lowestoft aforesaid in my own Occupation. And Also all other my Messuages Lands and Hereditaments whatsoever and wheresoever And the said Sarah Sterry being present in Court as aforesaid puts herself into the ffavour of the Lord of the said Manor and humbly prays to be admitted Tenant to the Copyhold Lands and Tenements so Devised to her as aforesaid - that is to say To One(?) Copyhold Messuage situate in Lowestoft aforesaid next the Messuage late of Thomas Mighells now of Barsham Boldra on the South part and the Messuage late of Robert Mondham now of Elizabeth Sattaway on the North part and abutting upon the Land late of the said Thomas Mighells and now of the said Barsham Boldra towards the East and upon the high street towards the West with the Appurtenances Which Premises the said Richard Robertson together with Esther his Wife had took up to them for and during the term of their Natural Lives and the Life of the longer liver of them with Remainder to the heirs and assigns of the said Richard Robertson for ever at the said General Court Baron held for the said Manor the said Eleventh Day of November which was in the said Year of our Lord One thousand and seven hundred and forty one on the absolute surrender of Edward fferney and by the Rolls of the said Court reference being thereunto had may more fully and at large appear To which said Sarah Sterry the Lord of the said Manor by the proper hands of his said Steward doth grant and deliver seizin of all the said premises by the Rod To hold to her and her heirs of the Lord at the Will of the Lord according to the Custom of the said Manor and fform and effect of the said Bill by the Rents and services therefore anciently be and of Right accustomed saving. Nevertheless every ones right thereto &c. And paying the Lord of the said Manor a ffine &c she is admitted Tenant to the said premises but her fealty to be done for the same is on the Lord ffavour respited &c.

And Immediately afterwards the Court still sitting come into Court the aforesaid James Sterry together with the said Sarah his Wife and she the said Sarah being by the said Steward first solely and secretly examined apart from her said husband and consenting as the Law Requires did surrender out of their and either of their hands into the hands of the Lord of the said Manor by the proper hands of the said Steward by the Rod according to the Custom of the said Manor All and singular the Messuages Lands Tenements and Hereditaments whatsoever of her the said Sarah held of the said Manor by Copy of Court Roll with their Appurtenances To the use and Behoofe of the last Will and Testament or Writing purporting to be the last Will and Testament of the said Sarah Sterry Writing notwithstanding coverture declared or to be declared.

And also at his court it is presented by the homage and also certified by the said steward that on the ffirst day of June instant William Sterry of Lowestoft in the county of Suffolk mariner and Elizabeth his wife copyhold tenants of the said Manor came before him the said Steward in their own proper persons And - she the said Elizabeth being by him she said steward first solely and secretly examined apart from her said husband and consenting as the law requires - Did - out of court by the rod according to the custom of the said Manor surrender out of their and either of their hands into the hands of the Lord of the said Manor by the proper hands of him the said steward in the presence and testimony of Samuel Collett a credible person attesting the same All and singular their and either of their messuages lands tenements and hereditaments whatsoever held of the said Manor by copy of court roll with their and every of their appurtenances And the reversion and reversions remainder and remainders thereof and all the estate right title interest claim and demand whatsoever of them the said William Sterry and Elizabeth his wife or either of them of in or to the same premises and every part thereof To the use and behoof of Jeremiah Blowfield of Wakefield in the county of Suffolk Yeoman his heirs and assigns for ever provided always and upon condition nevertheless that if the said William Sterry and Elizabeth his wife or either of them their or either of their heirs executors administrators should and did well and truly pay or cause to be paid unto the said Jeremiah Blowfield his Executors Administrators or Assigns the full sum of Thirty ffive Pounds of good and lawful money of Great Britain being the same sum of money mentioned in the condition of a certain bond bearing even date therewith made and entered into by the said William Sterry to the said Jeremiah Blowfield in the penal sum of seventy pounds with lawful interest therefore on the ffirst day of June which will be in the year of our Lord one thousand seven hundred and seventy five without any deduction whatsoever Then the said surrender to be void otherwise to be and remain in full force and virtue.

in the county of Suffolk yeoman and of his heirs and assigns for ever absolutely and without any manner of Condition whatsoever Who being present in Court in his own proper person putts himself into the favour of the Lord of the said Manor and humbly prays to be admitted tenant to the Copyhold lands and tenements so surrendered to his use as aforesaid that is to say To all that messuage or tenement situate and being in Lowestoft aforesaid consisting of one Law room two Chambers over the same and a garret over the Chambers and a washhouse at the North end of the said tenement And also a piece of Land to the Northwards of the said washhouse a certain way or passage of about four feet wide lying between) which said piece of land contains in length from North to South twenty eight feet or thereabouts and in breadth from East to West sixteen feet or thereabouts as all the said premises are in the occupation of the said William Sterry and abut upon the lands and tenements of Obed Aldred on the parts of the North South and West and upon the high street of Lowestoft aforesaid towards the East together with the free and unrestrained use of the passage there at all times and by all the ways and openings into it now being or in use by and through the door opening into the street and the door opening into the said washhouse And also the use of the wall near these at all times by the present ways leading thereto bearing a fourth part of the expence in the reparation thereof and of the stops ropes and other articles thereto belonging. And all other rights and appurtenances to the said surrendered premises or any part thereof belonging which premises the said William Sterry and Elizabeth his wife late had and took up to them for life and the life of the survivor of them with remiander to the right heirs of such survivor for ever on the absolute surrender of Obed Aldred at a general Court baron held for the said Manor the twenty third day of December which was in the year of our Lord One thousand seven hundred and seventy two as by the rolls of that Court reference being thereto had may more fully appear. Louisa Ward Sterry and Emma Mary Sterry admitted after the death of Anne Ward and under the will of Mary Ward

2nd March, 1877

Whereas at a General Court Baron holden for this Manor on the seventh day of May one thousand eight hundred and seventy four Anne Ward of Lowestoft in the county of Suffolk spinster was admitted tenant after the death and under the will of Mary Ward deceased then late a copyhold tenant of this manor to the copyhold hereditaments hereinafter mentioned to hold to her and her assigns for and during her natural life. And whereas at a General Court Baron holden for this manor on the sixth day of December one thousand eight hundred and seventy five it was presented by the homage thereof that the said Anne Ward died before that court solely seised of and in certain copyhold lands and tenements holden of this manor and for want of a tenant thereto the first proclamation was made that if any person or persons would come into court and make any first claim or title to the same they should be heard and received. But no one then came. Now to this court come Louisa Ward Sterry and Emma May Sterry both of Lowestoft in the county of Suffolk spinsters (by Charles Thomas Turner on this their attorney) and produce the probate of the last will and testament of Mary Ward late of Lowestoft aforesaid spinster a copyhold tenant of this manor dated the thirteenth day of November one thousand eight hundred and sixty eight the tenor whereof as to the disposition of her copyhold lands and tenements holden of this manor follows in these words - that is to say - "This is the last will and testament of me Mary Ward of Lowestoft in the county of Suffolk spinster. I appoint my sister Anne Ward sole executrix hereof. I devise unto my sister the said Anne Ward for life all those my four copyhold tenements or dwellinghouses recently purchased by me of Reynolds Executors and situate in Spurgeons Score at Lowestoft aforesaid with the appurtenances together with all other the real estate of which I shall die possessed she keeping the same in good and tenantable repair and insured against loss or damage by fire and from and immediately after her decease I give and devise the said four tenements or dwellinghouses hereditaments and premises and real estate with the appurtenances unto and to the use of my two nieces Louisa Ward Sterry and Emma Mary Sterry their heirs and assigns for ever as tenants in common and not as "joint tenants". As by the same will proved in the District Registry of Her Majesty's Court of Probate at Ipswich on the third day September one thousand eight hundred and seventy three reference being thereunto had may more fully appear. And the said Louisa Ward Sterry and Emma Mary Sterry being still present in Court as aforesaid put themselves into the favor of the Lord of this manor and humbly pray to be admitted tenants to the copyhold lands and tenements so devised to them as aforesaid - that is to say -

All that piece of land situate lying and being at Lowestoft aforesaid being part of a piece of land late of Sharman Brame formerly Edmonds as the said piece or parcel of land contains by admeasurement sixty six feet in front next Spurgeons Score seventy feet in breath at the southern extremity thereof and ninety six feet the whole length of the same north and south together with the four tenements or dwellinghouses erected and built thereon as the same abuts upon the said Score on the part of the north upon land premises of Benjamin Morris Edmonds Charles Pamchard and others on the part of the west upon land and premises formerly of the Corporation of Great Yarmouth and now of William Thuirte on the part of the south and upon messuages and land late of Thomas Chaplin and now of Thomas Francis Sayer on the part of the east with with the right at all times hereafter of having and saveing water from the well and pump standing and being on the said land and premises paying from time to time a proportionate part of the expenses of the repairs thereof which premises the said Mary Ward had and took up to her and her heirs pursuant to the statute in that case made and provided on the nineteenth day of July one thousand eight hundred and sixty eight on the absolute surrender of Cornelius Reiprolds and James Bird as by the rolls thereof reference being thereunto had may more fully appear To which the said Louisa Ward Sterry and Emma Mary Sterry (by their paid attorney) the Lord of the manor by the proper hands of the said deputy steward doth grant and decree seizin of all the said premises by the rod. To hold to them the said Louisa Ward Sterry and Emma Mary Sterry their heirs and assigns for ever as tenants in common and not as joint tenants of the Lord at the will of the Lord according to the custom of this manor and form and effect of the said will by the rents and services therefore annually due and of right accustomed service nevertheless every ones right thereto etc. And paying the Lord of this manor a fine etc. They ( by their said attorney) are admitted tenants thereto but their fealties to be done therefore are on the Lords favour respited.

And also to this court come Robert Sterry the younger of Lowestoft in the county of Suffolk Mariner and Sarah his wife copyhold tenants of the said manor in their own proper persons and in open court before the homage she the said Sarah being by ___ the said steward first solely and separately examined apart from her said husband and consenting as the Law requires do surrender out of their and each of their hands into the hands of the Lord of the said manor by the proper hands of the said steward by the rod according to the custom thereof all their and each of their messuages lands tenements and hereditaments whatsoever holden of the said manor by copy of court roll with their and every of their appurtenances and the reversion and reversions remainder and remainders thereof and also all the estate right title use interest trust equity property claim and demand whatsoever of them the said Robert Sterry and Sarah his wife or of either of them of in or to the same and every part and parcel thereof to the only use and behoof of William Butcher of Lowestoft aforesaid yeoman and of his heirs and assigns for ever absolutely and without any manner of condition whatsoever

Whereas at a court held for this mannor on the thirteenth day of March now last past it was presented by the homage that William Knights a copy hold tenant of this mannor did out of court according to the custom of this mannor surrender all his copyhold lands tenements and hereditaments holden of this mannor by copy of Court Roll with their appurtenances to the use and behoofe of Susanna Sterry of Lowestoft in the county of Suffolk widow her heirs and assigns forever without any manner of condition whatsoever now at this court comes the said Susanna Sterry by Mary Ellett in this part her attorney and desires the the favour of the Lord of the Mannor to admit her tenant to the lands and premises so as aforesd surrendered to her to wit. To one tenement in which James Spratt formerly dwelt and in which Peter Dixon now dwell situate lying and being in Lowestoft aforesd abutting upon the house of Philip Bateman towards the west and upon the house and tenemt of John Smith towards the East and lying between the land of John Wilde of the south part and the Lords wast called Rant Score on the north part and also to a yard to the same belonging containing length from east to west fourteen feet and eight inches and in length from the north to the south thirty nine feet and a half situate and being in Lowestoft aforesd. Which premises the sd William Knights had and took up at a court held for this mannor on the twenty fifth day of April 1744 as appears and the sd Susanna Sterry widow admitted tenant thereto. To whom the Lord of the Mannor by the hands of the aforesd steward hath delivered seizin thereof by the rod to hold to her her heirs and assigns according to the form and effect of the aforesd surrender at the will of the Lord according to the custom of this Mannor by the rents and service therefore due and right accustomed saving every ones right etc. And she paid to the Lord a fine etc. And her fealty is respited until etc.

Timothy Sterry admitted after the death and under a bargain and sale from the executor George Rix

14 May 1872

And also to this court it is presented by the homage aforesaid that George Rix a copyhold tenant of this manor died before this court solely seized of and in certain copyhold lands and tenements holden of this manor. And thereupon comes into court Timothy Sterry of Lowestoft in the county of Suffolk Twine Spinner in his proper person and produces an indenture of bargain and sale impressed with a twelve shilling and six pence ad valorem stamp bearing date the twenty second day of February one thousand eight hundred and seventy two and expressed to be made between Robert Dumbleton of Great Yarmouth in Norfolk Slate Merchant of the one part and the said Timothy Sterry of the other part. Whereby after reciting that the said George Rix then late of Lowestoft aforesaid Bricklayer deceased being in his lifetime and at the time of his death seized of or otherwise well entitled to the hereditaments thereinafter described and thereby bargained and sold or intended so to be for an estate of inheritance to him and his heirs according to the custom of this manor did duly make and execute his last will and testament in writing bearing date the thirteenth day of January one thousand eight hundred and sixty three and thereby gave and devised all the freehold messuages or tenements lands and hereditaments whatsoever and wheresoever of in or to which he or any person or persons in trust for him should at the time of his decease be seized interested or entitled in possession reversion remainder or expectancy or otherwise howsoever or over which he had or might have any ....

Also at this court it is presented by the homage that Susanna Sterry late copyhold tenant of this mannor died since the last court seized of certain lands and tenements holden of this mannor by copy of court roll and sitting the court comes into court Thomas Ellott only son and heir at law of the said Susanna Sterry in his own proper person and desires the favour of the Lord of this mannor to admit him tenant to the premises of which the said Susanna Sterry his late mother died seized as to his right and inheritance (to wit)

formerly in the tenure of John George and late in the occupation of the said Susanna Sterry (late Jessup) situate and being in Lowestoft aforesaid next the tenement and ground late of Nicholas Pye formerly in the occupation of John Norman on the part of the east and a common pasture called the pound green on the part of the west and abutt upon a common street called the Swan Lane towards the north and upon the land late of William Mason towards the south and to a moiety of one half part of a wall called the Gable or wall dividing the aforesaid tenement and the tenement next adjoining late of the said Nicholas Pye and late in the the occupation of John Press and also free liberty of ingress egress and regress to the tenement and to the well there being in the ground in the use of the said John Press adjoining next to the east part of the aforesaid tenement to draw take and carry water therefrom by all usual ways and means she the said frames and her heirs and assigns from time to time and at all times hereafter bearing paying and allowing one eighth part of the charge and expense of the necessary repairing the said well and all things to the same belonging which premises the said Susanna Sterry by the name of Susanna Jessup widow also had and took up to her and assigns for the term of her life by and under the surrender and will of the said Edmund Jessup declared at a court held for this mannor on the said twenty third day of October which was in the year of our Lord one thousand seven hundred and twenty three
